Terms of Service
Last updated 27 September 2026 · applies to aitizer.com, app.aitizer.com, the API, the Vibe Coding engine and apps published through AITIZER
In one paragraph. You get a platform to build software on your own data; we keep it running, secure and up to date. Your data and the code you generate are yours. You pay for the plan you pick and for the AI credits you use; a trial requires a card and converts into a paid plan unless you cancel before it ends. Don't use the Service to break the law or harm others. AI can be wrong, so check what matters. We are not liable beyond what you paid us in the last 12 months. You can leave any time and take your data with you.
1. Agreement
These Terms of Service (the "Terms") are a binding agreement between you. The person or company that creates an account or is added to a workspace. And AITIZER ("AITIZER", "we", "us") for the use of the website aitizer.com, the application at app.aitizer.com, the API, the MCP server, the Vibe Coding engine, published-app hosting and everything else we offer under the AITIZER name (the "Service"). By creating an account, accepting an invitation or using the Service you accept these Terms and our Privacy Policy. If you act for a company, you confirm you have authority to bind it.
If you have a separately signed agreement with us (for example an Enterprise contract or a Data Processing Agreement), that agreement prevails where it conflicts with these Terms.
2. Eligibility and accounts
You must be at least 18 and legally able to contract. You are responsible for your credentials and for everything done with your account or tokens; tell us immediately at hi@aitizer.com if you suspect unauthorised use. Workspace administrators are responsible for the members they invite and the roles they grant.
3. Plans, credits and usage
- Plans. Features and limits (members, app users, tables, published apps, custom domains, API access, agents, storage) are those of the plan shown on aitizer.com/pricing at the time of purchase. Limits are enforced by the Service; when you reach one you are told and offered an upgrade.
- AI credits. AI features consume credits. One credit equals 1,000 billed tokens; billed tokens are the tokens the AI provider charges us for, multiplied by the model's rate shown next to it before you pick it. Every plan includes a monthly allowance; unused plan credits roll over one period. Credit packs never expire while your account is active. When credits run out AI features pause until you top up, upgrade or enable automatic recharge with a monthly cap you control; your data, apps and non-AI features keep working.
- Bring your own keys. On plans that allow it you may connect your own AI provider keys; that usage is billed by the provider, costs zero AITIZER credits and is governed by your agreement with the provider.
- Fair use. Plans are priced for normal business use. We may throttle or contact you about usage that is abusive, automated far beyond the plan's intent or that degrades the Service for others.
4. Trial, billing, cancellation and refunds
- Trial. New customers may start a 7-day trial of a paid plan. A valid payment card is required. At the end of the trial the plan converts to a paid subscription and the card is charged, unless you cancel before the trial ends. In which case nothing is charged and the workspace moves to the Free plan with your data intact. One trial per customer.
- Payments. Subscriptions are billed in advance, monthly or yearly, in US dollars through Stripe. Taxes are added where required. By subscribing you authorise recurring charges until you cancel. Prices may change with at least 30 days' notice; changes apply from your next billing period.
- Failed payments. If a charge fails we retry and notify you. After the retries your workspace becomes read-only for AI and publishing until payment succeeds, and after 30 days it moves to the Free plan. We never delete your data because of a failed payment.
- Cancellation. You may cancel any time from the billing panel. The plan stays active until the end of the paid period, then the workspace moves to the Free plan (or stays deactivated, at your choice) and you can export everything.
- Refunds. Monthly fees and credit packs are non-refundable once the period starts or the credits are delivered, except where the law requires otherwise. Yearly plans may be refunded in full within 14 days of purchase if less than 10% of the included credits were used. Consumer rights that cannot be waived in your country are unaffected.
5. Your content and your apps
- Ownership. You own the data you put into AITIZER, the tables and views you build, the prompts you write, the agents you configure and the source code the Vibe Coding engine generates for you ("Customer Content"). We claim no rights over it.
- Licence to us. You grant us only the licence needed to host, process, back up, display and transmit Customer Content in order to run the Service as you configure it, and to comply with the law. We never use Customer Content to train AI models.
- Your responsibility. You are responsible for Customer Content, for having the right to use it, and for how your apps and agents treat the people who use them. If you publish an app, connect WhatsApp or Telegram, or collect data from App Users, you are the data controller for those people and must provide them your own privacy notice and comply with the law that applies to you. We act as your processor under the Privacy Policy and, where you need it, our Data Processing Agreement.
- Published apps and domains. Apps you publish run on our infrastructure at a URL we provide or on a domain you own and verify. You must have the right to use that domain. We may take down a published app that violates these Terms.
- Export. You can export tables to Excel, CSV and JSON, download your apps' source code and pull it through Git at any time. Leaving is a feature.
6. Third-party services and credentials
The Service lets you connect third-party services. AI providers, payment processors, messaging platforms, the 240+ integrations in the catalogue and any HTTP API you configure. Those services are governed by their own terms and prices; you are responsible for having a valid account with them and for the credentials you store with us (which we keep encrypted and use only to make the calls you configured). We are not responsible for a third party's availability, behaviour, fees or changes to its API.
7. Artificial intelligence
AI features generate text, code, decisions and actions from models we do not control. Outputs may be inaccurate, incomplete, biased or unsuitable, and may occasionally resemble content produced for others. You are responsible for reviewing outputs before relying on them and for any action an agent or automation takes on your instructions. AI features are not a substitute for professional legal, medical, financial or other advice. You must not use them to generate content that is illegal, deceptive, harmful or that infringes others' rights.
8. Acceptable use
You must not, and must not allow others to:
- break the law, infringe intellectual property, or violate anyone's privacy or publicity rights;
- send spam or unsolicited messages through agents, WhatsApp, Telegram, e-mail or any channel, or violate the rules of the messaging platform you connect;
- upload malware, attempt to access other customers' data, probe or overload our infrastructure, or circumvent limits, sandboxes or security controls;
- scrape the Service, resell access to the API or MCP server without our agreement, or misrepresent AITIZER as your own product except through the white-label features we provide;
- use the Service to build or run applications for high-risk activities where failure could cause death, injury or severe damage, unless we have agreed in writing;
- host content that is sexually exploitative of minors, incites violence or promotes terrorism.
We may suspend or remove content or accounts that violate this section, after notice where practical. Security research is welcome: report vulnerabilities to hi@aitizer.com and we will not pursue good-faith researchers who respect other customers' data.
9. Our commitments
We will run the Service with reasonable skill and care, keep it secure as described in the Privacy Policy, back it up daily, and tell you about planned maintenance in advance when possible. We may change, add or retire features; we will not materially reduce the core functionality of a paid plan during a paid period without notice. Service levels, uptime guarantees and support response times are only those written in an Enterprise agreement; other plans are provided on a best-effort basis.
10. Intellectual property
The Service. Its software, design, documentation, templates, the Vibe Coding engine, the MCP server and the AITIZER name and marks. Belongs to AITIZER and its licensors. You receive a limited, non-exclusive, non-transferable right to use it under these Terms. Open-source components are licensed under their own terms. Source code generated for you is Customer Content and is yours; templates and libraries we embed in it remain under their licences, which permit that use. Feedback you send us may be used without obligation.
11. Confidentiality
Each party will protect the other's non-public information with at least reasonable care and use it only for the purposes of these Terms. Customer Content is your confidential information. We may disclose information when legally required, telling you first where the law allows.
12. Suspension and termination
You may terminate at any time by deleting your account or workspaces. We may suspend or terminate your access if you materially breach these Terms and do not cure the breach within 10 days of notice, if we must do so by law, or if your account is unpaid as described in section 4. After termination you have 30 days to export Customer Content, after which it is deleted as described in the Privacy Policy. Sections that by their nature should survive (payment, ownership, liability, confidentiality, governing law) survive termination.
13. Warranties and disclaimers
Except as expressly stated in these Terms, the Service is provided "as is" and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, to the extent permitted by law. We do not warrant that the Service, AI outputs or third-party services will be uninterrupted, error-free or suitable for your purposes.
14. Limitation of liability
To the extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, however caused. Our total liability for all claims arising out of the Service in any 12-month period is limited to the amounts you paid us for the Service in those 12 months. These limits do not apply to a party's fraud, wilful misconduct, breach of confidentiality, or to liability that cannot be limited by law. Including the rights of consumers under the Brazilian Consumer Code where it applies.
15. Indemnity
You will defend and indemnify AITIZER against third-party claims arising from Customer Content, from your apps and agents and their treatment of App Users, or from your breach of these Terms or the law. We will defend and indemnify you against third-party claims that the Service itself (excluding Customer Content and third-party services) infringes their intellectual property, provided you notify us promptly and let us control the defence.
16. Changes to these Terms
We may update these Terms. For material changes we give at least 30 days' notice by e-mail and in the app; continuing to use the Service after the effective date means you accept them. If you disagree, stop using the Service before that date and we will refund any prepaid, unused period.
17. Governing law and disputes
These Terms are governed by the laws of the Federative Republic of Brazil. Disputes will be resolved in the courts of the city where AITIZER has its registered seat, unless you are a consumer entitled by mandatory law to the courts of your own domicile, in which case that right is preserved. Before starting a proceeding, both parties agree to try to resolve the dispute by writing to each other for 30 days.
18. General
These Terms, the Privacy Policy and any signed agreement are the entire agreement between us. If a provision is unenforceable the rest remains in effect. Neither party may assign the agreement without consent, except to a successor of its business. Notices to us go to hi@aitizer.com; notices to you go to the e-mail address on your account. Neither party is liable for failure caused by events beyond its reasonable control.
19. Contact

These Terms are written in plain language and translated into other languages for convenience. If a translation differs from the English version, the English version prevails, except where the law of your country requires otherwise.
